Itality LTD (http://www.amoritalia.my/) owns and operate this Website. This document governs your relationship with amoritalia.my. Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service, which may be updated by us from time to time. You should check this page regularly to monitor any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.
This Website may contain links to other websites, which are not operated by amoritalia.my. amoritalia.my has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

Terms of Sale

By placing an order you are choosing to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with amoritalia.my you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. amoritalia.my retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be amoritalia.my or may in some cases be a third party. Where a contract is made with a third party amoritalia.my is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

Shipping and Delivery

When we receive your order you will be notified via e-mail. All orders received will be processed for delivery within 24 to 48 hours, If the good is in stock it will be send out immediately. If it has to be produced it could take from 2 to 3weeks. When ready you will be notified via email and supplied with a tracking number so you can check the status of your order on line. Please refer to shipping and delivery for further information.
In any case we will contact you via email outlining the problem and if necessary, we may request for further information.
Orders received on a public holiday or weekend will be processed the following business day.
When your payment details have been approved and your order has been processed for shipment you will be notified via email and provided with a tracking number so you can check the status of your order online.
It is not possible to select a date or time of delivery, therefore you should provide an address where someone will be able to receive your parcel. The couriers will make two attempts to deliver your parcel to your door. If both attempts fail, then it will be the customer’s responsibility to contact the courier to make necessary arrangements for pick up. Please note we do not deliver to P.O Boxes.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund; except in those cases where the product is made on order. In these cases the refund will be subject to specific refund policies written on the product page.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’. For more informations go to Shipping and Delivery.

Payment

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

Delivery Charges

We base our delivery prices on the size and weight of what you’re buying. You will be able to see the cost of your parcel at checkout prior to entering your adress details.

Savings on Delivery

We know how important it is for our customers to save money where possible. So why not place an order with a friend or family member that way all items can be shipped in one parcel and you both share the shipping cost. Please note if you choose to share the shipping costs all items must be paid with one credit card and shipped to the nominated address. Please note all our products are insured at no extra cost to the customer.

Delivery Time

It depends if the product is in stock or it has to be produced and it depends on the country of destination. Please remember that all the products are sent from Italy and many of them are made artisanal on the moment of the order*.

Tracking

Once you’ve placed an order, just log in and go to ‘My orders’ where you’ll see all the products you’ve bought. Select an item and we’ll take you to a tracking page that’ll tell you exactly where it is.

Taxes and Duties

VAT is included in destinations within the EU.
All international shipping costs excluding EU do not include custom duties, import taxes or fees that maybe required upon receipt of items. Payment of custom duties, import taxes or fees, if any, 8’9pis the customer’s responsibility. It’s impossible to know exactly what all the import taxes, custom duties or fees. We do our best to calculate all of them, but in some cases the regulation could change and you will have to pay something extra. In this instance the customer will be responsible to pay the courier the cash amount when goods are delivered.

Returns

If for any reason you are dissatisfied with your purchase, you can return it within 14 working days of receipt.

Terms and conditions for return:

-The order must be checked when received or as soon as possible.
-If after checking your order you need to return it, please send an e-mail to support@amoritalia.my within 24 hours.
-We will respond to your request and send you useful  information for the return process. The item must be returned within 14 working days.
-All items must be returned in the same conditions in which they were received, with the original packaging and no missing parts.
-Shipping costs are charged to the customer. We recommend insured shipments and the use of tracking codes. The customer is responsible for the package until its delivery to our storehouse. Amoritalia.my will not be responsible for any loss or damage to the package/item.
For extra EU shipments there may be extra charge due to custom duty and taxes.
-We will not accept returns for damaged or used items. As to say, we will not accept items with scratches, abrasions, damages due to negligence or bad use, as well as modifications or attempted repair.
-amoritalia.my – Itality LTD reserves the right to refuse items that do not meet these conditions and the given directions for the return. In this case the item will be returned to the customer that will pay for the shipping costs.

What if the item is damaged when it arrives or you are sent the wrong item?

If you’re unhappy with the quality, or if we’ve sent you the wrong item, just contact us within 24 hours of delivery or as soon as possible, ideally sending us a couple of photos of the damage or other issues with the product. Our team will assess your complaint and, assuming your complaints are valid, arrange to collect the item from you and either give you a full refund, arrange for a repair, or order you a replacement. It’s very important that you inspect your product upon delivery, as we’ll ask you to sign a form confirming that it was received in a good condition, otherwise collect the parcel “with reserve”. If you’re not happy with the goods when you inspect them, note this on the form and contact support@amoritalia.my.*

Refunds

 Timeframe for refund

When Itality LTD receives the returned product, we will check and verify that all necessary requirements have been met as per our Term and Condition of return. The customer will then receive an email confirming that the return has been accepted and the amount of the returned product excluding shipping charges will be reimbursed.

When approved we will process the refund as per your original payment method. Unfortunately we have no control over the financial institution. The estimated time frame is approx. 5-10 working days of receipt of goods.

Disclaimer of Liability

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law amoritalia.my and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect amoritalia.my’s liability for death or personal injury arising from its negligence, fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Linking to this Website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

Variation

amoritalia.my shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments at support@amoritalia.my.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and amoritalia.my. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of amoritalia.my.
